Nominated Supervisor

7.3   NOMINATED SUPERVISOR

It is a requirement of National Law and Regulation that the Centre appoints one educator as a Nominated Supervisor.  A Nominated Supervisor is a person who is a Certified Supervisor and has been nominated by the Approved Provider to be in day-to-day charge of the Centre and has consented to that nomination in writing.

The Nominated Supervisor has a range of legal responsibilities under the Law and Regulations that govern the operation of education and care services.  They are responsible for the day to day management of the Centre, including but not limited to areas such as; educational programs are delivered based on EYLF and on the developmental needs, interests and experiences of each child and their individual differences, adequate supervision and safety of children, ensuring no child is subjected to corporal punishment or unreasonable discipline, children are protected from hazards and harm, and qualifications and educator to child ratios are being met.

The Nominated Supervisor does not need to be in attendance at the Centre at all times.  When the Nominated Supervisor is not in attendance, another team member who holds a Supervisor Certificate can consent to being placed in charge of the Centre on an acting basis.  As a Responsible Person, Certified Supervisors who are placed in day-to-day charge of the Centre are NOT the equivalent of the Nominated Supervisor and do not have the same responsibilities under the National Law as the Nominated Supervisor.
